Amityville Mobile Home Civic Association v. Frontier Park Corp. et al.

Suffolk County Index # 29026/2013 (Suffolk County Sup. Ct. 2014). Residents of a twenty-acre mobile home park slated for redevelopment by our client challenged the issuance of change of use notices to them pursuant to Real Property Law § 233, and sought damages against our client variably for fraud, violation of statutory rights, and tortious interference with prospective economic advantage. They also sought an injunction to prevent our client from terminating their tenancies at the mobile home park. The Supreme Court granted our motion for summary judgment, rejecting each claim as a matter of law and dismissing the lawsuit in its entirety.
