Hasson v. S.B.J. Associates, LLC

36 Misc.3d 1242(A) (Suffolk County Sup. Ct. 2012), aff’d, 117 A.D.3d 904 (2d Dept.), lv. denied, 24 N.Y.3d 910 (2014).  On behalf of the owners of condominiums in the 1,144 unit senior residential development known as The Greens at Half Hollow, we successfully enforced against the developer the requirements of an open space plan for the property approved by the Town of Huntington.  As a result of that Supreme Court ruling, which was upheld on appeal, the developer was required both to remove a building and improvements it had unlawfully built upon a two-acre parcel of land and to deed that parcel to the residents’ homeowner association.
