Matter of Amityville Mobile Home Civic Association v. Town of Babylon, et al.

Suffolk County Index # 9973/2012 (Suffolk County Sup. Ct. 2014).  We successfully represented the owner and developer of a 20-acre parcel of land approved by the Town of Babylon for redevelopment from a mobile home park into a multi-use property with residential apartments and retail stores.  The residents of the mobile home park challenged the re-zoning resolution, alleging technical issues with respect to the ownership of the property and the subject matter jurisdiction of the Town Board, which the Supreme Court rejected as “specious and dehors the record,” and belied by the facts.  In dismissing the lawsuit, the Supreme Court also rejected the residents’ contention that the municipal approval had been issued in violation of the State Environmental Quality Review Act.
