Petersen v. Incorporated Village of Saltaire

77 A.D.3d 954 (2d Dept. 2010).  The Appellate Division reversed a lower court ruling and agreed with us that our municipal client, Village of Saltaire (located on Fire Island), could not be restrained to hold public meetings within the Village borders.  The case was colored by the fact that the Village is a seasonal community accessible by a ferry system which is often shut down during winter months.  The ruling represents a significant matter of first impression, confirming that no law compels a Village Board to physically meet only within its borders, and recognizing the rapidly developing legal utility of videoconferencing public meetings.
