Speichler v. Board of Co-op Educ. Servs.

90 N.Y.2d 110 (1997).  We successfully represented a discharged teacher in a proceeding for reinstatement and back pay.  The Court of Appeals agreed with our argument that the teacher had acquired tenure by estoppel under the Jarema Statute based upon her prior employment as a regular substitute teacher, even though the School District called her a per diem substitute.  The case cut new ground in terms of Jarema Credit being awarded, even though the replaced teacher was not out on a “definite” leave.
