323 F.3d 178 (2d Cir. 2003).  The Second Circuit Court of Appeals agreed with us that the Chairman of a political party, who is alleged to have conspired with governmental officials to rescind an individual’s zoning variance and building permit in violation of that individuals constitutional rights, is not entitled to immunity on the basis of his position alone or on the basis that he was merely advocating that local government take a particular legal or adjudicative action.
