73 A.D.3d 1030 (2d Dept. 2010).  In this litigation, we successfully established a prima facie case of our commercial client’s entitlement to a prescriptive easement over the neighboring commercial property owner’s driveway.  As a result of the defendant’s default, the Appellate Division reversed a contrary Supreme Court decision and awarded our client judgment.
